1. Introduction and acceptance
These terms of use (the "Terms") govern access to, and use of, the Cocodum website (the "Website"). The Website is run by a team ("Cocodum", "we", "us" or "our"), which may be contacted at contact@cocodum.com. The Website is free of charge: Cocodum charges nothing and takes no payment.
These Terms apply to any person who accesses or uses the Website (the "User", "you"). By accessing or using the Website – whether to browse, to register an account or to post Content – you acknowledge that you have read and understood these Terms and agree to follow them. If you do not accept these Terms, you must refrain from using the Website.
Language. These Terms are furnished in English and in French. In the event of any discrepancy or ambiguity between the two versions, the English version shall prevail.
Amendments. Cocodum may amend these Terms from time to time, in particular in order to reflect changes in applicable law or in its services. The version published on the Website is the version in force from time to time. Where an amendment is material, Cocodum shall take reasonable steps to notify Users. Continued use of the Website following the entry into force of an amendment constitutes acceptance of the amended Terms.
Effective date of the present version: 20 October 2026.
2. Definitions and interpretation
For the purposes of these Terms, the following definitions apply:
- "Ad" (annonce) means any classified advertisement published on the Website.
- "Event" means any event listing published on the Website.
- "Content" means any material submitted, posted or displayed on the Website by a User, including text, photographs, images, prices and messages.
- "User" ("you") means any person who accesses or uses the Website.
- "Private" means a User acting for purposes that are wholly or mainly outside that person's trade, business, craft or profession (that is to say, a consumer).
- "Trader" means a User acting for purposes relating to that person's trade, business, craft or profession, whether personally or through another person acting in its name or on its behalf.
References to a "Section" are to a section of these Terms; words in the singular include the plural and vice versa; and headings are included for convenience only and do not affect interpretation.
3. Eligibility – age requirement
The Website is intended exclusively for persons aged 18 or over. In order to use the Website, register an account or post Content, you must be at least 18 years of age. By using the Website, you confirm that you satisfy this requirement.
Romantic dating. Ads in the "Romantic dating" subcategory are reserved for adults: a User may post such an Ad, or answer one, only where the year of birth given in its account shows it to be aged 18 or over.
Cocodum reserves the right to refuse access to, and to suspend or close, any account where it reasonably believes that a User does not satisfy these requirements.
4. Registration and account
In order to post Content or access certain features, you must register an account and provide information that is accurate, current and complete, and keep that information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account.
- You must notify Cocodum without undue delay at contact@cocodum.com in the event that you suspect any unauthorised use of your account.
- You must not register an account using another person's identity, operate more than one account in order to circumvent any restriction, or transfer your account to any third party without Cocodum's prior consent.
- A Trader must register and use a Trader account (see Section 16). The use of a Private account for business purposes constitutes a breach of these Terms.
- Every application for a Trader account is reviewed manually by our team, and a Trader account becomes active only once its application has been reviewed and approved. Cocodum may refuse an application.
5. Nature of the service – Cocodum acts as host only
The Website publishes classified advertisements and event listings: it provides a venue on which Users may publish and consult Ads and Events. Cocodum is not involved in any sale, letting, exchange, booking or other transaction between Users, and acts neither as buyer, seller, agent, broker, auctioneer, employer, event organiser nor payment intermediary.
- Cocodum does not participate in, guarantee, verify or supervise any dealing between Users. It neither holds, inspects, delivers nor handles any item, and it does not process, hold or transfer any payment between Users. All contact, negotiation, payment and exchange between Users takes place directly between them, outside the Website, and at their own risk.
- Apart from the manual review of Trader applications, Cocodum does not systematically verify the identity of Users or the accuracy, quality, lawfulness or safety of any Ad, Event, item, service or Content, and the approval of a Trader account is not a guarantee of that Trader. Any reliance placed thereon is at the User's own risk.
- The User is responsible for taking all reasonable precautions when dealing with other Users. Our Safety page provides guidance which is not exhaustive and which does not relieve the User of the obligation to exercise its own judgement, common sense and caution.
6. User Content – responsibility
The User is solely responsible for, and shall bear all liability arising from, the Content that it posts, as well as its Ads and Events. By posting Content, the User confirms that:
- the Content is accurate, not misleading and lawful;
- the User owns, or is otherwise entitled to sell, let or offer, the items or services advertised, and holds all rights necessary to post the Content (including all images and text);
- the Content does not infringe the rights of any third party (including intellectual property, privacy or image rights) and contravenes neither any applicable law nor these Terms;
- the Ad or Event is placed in the appropriate category and complies with Cocodum's posting rules, including the prohibited items and content set out in Section 15;
- where the User is a Trader, its Ads clearly disclose its business status and comply with all laws applicable to it (see Section 16).
Cocodum reserves the right to edit, recategorise, refuse or remove any Content that it reasonably considers to be in breach of these Terms, and may do so without prior notice (see Section 10).
7. Licence granted to Cocodum over User Content
The User retains ownership of the Content that it posts. By posting Content on the Website, the User grants Cocodum a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to host, store, use, copy, reproduce, adapt, translate, publish, display, distribute and communicate that Content, in whole or in part, in any medium whether now known or hereafter devised.
This licence entitles Cocodum, in particular, to display the Content on the Website and to use it for the purposes of operating, promoting, marketing and distributing the Website and its listings, including across its marketing channels and its partner or distribution channels. It expressly includes the right to copy and use the images supplied by the User for those purposes.
The User confirms that it holds all rights necessary to grant this licence. To the fullest extent permitted by applicable law, the User waives any moral rights it may hold in the Content. This licence shall survive the removal of the Content or the closure of the User's account to the extent necessary for Cocodum's records, backups and legitimate purposes.
8. Prohibited conduct
When using the Website, the User shall not:
- contravene any applicable law or regulation, or post any Content that is unlawful, fraudulent, misleading, defamatory, abusive, threatening, harassing, hateful, obscene or otherwise offensive;
- post any item or content listed as prohibited in Section 15;
- infringe the intellectual property, privacy or other rights of any person, or impersonate any person or organisation;
- transmit spam, chain messages, pyramid schemes or unsolicited advertising, or misuse the messaging function;
- upload any virus or malicious code, or otherwise interfere with, damage or disrupt the Website or its security;
- scrape, harvest, copy or extract data or User information from the Website by automated means, or collect the personal data of other Users in the absence of a lawful basis and their consent;
- attempt to obtain unauthorised access to the Website, to any account or to any system connected thereto, or circumvent any access or security measure;
- use the Website in any manner liable to damage Cocodum's reputation or otherwise inconsistent with these Terms.
9. Events
Where the Website permits Users to post Events, Cocodum provides visibility only. Cocodum does not organise, host, endorse, vet or run any Event, and does not sell tickets or handle any payment, booking or ticketing in respect of Events. Ticketing, admission, pricing and refunds are arranged entirely by the event organiser, outside the Website.
The organiser is solely responsible for the Event, including its lawfulness, any permits, licences, insurance, and health and safety, as well as its conduct and cancellation. Any User who attends or takes part in an Event does so at its own risk. To the fullest extent permitted by applicable law, Cocodum shall not be responsible or liable for any Event, for the conduct of any organiser or attendee, or for any loss, injury or damage arising in connection with an Event.
10. Moderation, reporting and removal of Content
Cocodum is committed to maintaining a safe and lawful Website and has put safeguards in place to moderate Content: every Ad and Event is checked automatically when it is posted and whenever it is edited, and any Ad or Event that fails the check is held for review by our team before it is published; an Ad or Event that receives several reports is suspended automatically until our team has reviewed them; and every application for a Trader account is reviewed manually (see Section 4). These safeguards are not perfect, and Cocodum is under no obligation to monitor Content proactively. Content is published under the sole responsibility of the User who posts it, and Cocodum is not responsible for it. Cocodum nevertheless reserves the right to review, moderate, refuse, edit, recategorise, restrict, take down or remove any Content, and to suspend or restrict any listing or account, where it reasonably considers the same to be in breach of these Terms or of any applicable law, or in order to comply with its legal obligations.
Reporting. Each Ad and Event is provided with a reporting tool. Where a User considers any Content to be unlawful, harmful or in breach of these Terms, the User should report it by means of that tool or by contacting contact@cocodum.com. Cocodum reviews all reports and takes such action as it considers appropriate.
Illegal content. Cocodum takes measures to identify and remove illegal content and to address reports thereof. Cocodum may remove such content, suspend or close accounts, preserve information, and report matters to law enforcement authorities where appropriate.
Intellectual property notices. Any person who considers that Content infringes its intellectual property rights should contact Cocodum at contact@cocodum.com, providing sufficient particulars to identify the Content and the rights concerned, whereupon Cocodum shall address the matter appropriately.
11. Suspension and closure
The User may cease using the Website and close its account at any time.
Cocodum may suspend, restrict or end the User's access to the Website or to any feature, and may remove the User's Content, at any time: (a) with immediate effect, where the User is in breach of these Terms or of any applicable law, where Cocodum is required to do so, or in order to protect the Website, other Users or third parties; or (b) otherwise, upon reasonable notice.
Upon the closure of an account or listing, Cocodum may retain certain data as described in its Privacy Policy and as required for legal, security and record-keeping purposes. The provisions of these Terms which by their nature continue to apply after the closure of an account (including Sections 7, 13, 14 and 20) shall continue to apply.
12. Cocodum's intellectual property
The Website and all of its constituent elements other than User Content – including its software, design, layout, text, graphics, logos and icons, together with the "Cocodum" name and branding – belong to Cocodum or its licensors and are protected by intellectual property laws.
Cocodum grants the User a limited, personal, non-exclusive, non-transferable and revocable licence to use the Website for its intended purpose in accordance with these Terms. The User shall not copy, reproduce, modify, adapt, translate, decompile, reverse-engineer or create derivative works from the Website or its software, nor remove any proprietary notice, save to the extent that such restriction is prohibited by law.
13. Disclaimers and exclusion of warranties
The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Cocodum gives no warranty or guarantee that the Website will be uninterrupted, error-free, secure or free from viruses, or that any Content, Ad, Event, User or third party is accurate, genuine, reliable, lawful or fit for any purpose.
Cocodum is not responsible for User Content or for the acts or omissions of any User or third party, including any dealing, transaction, item, service or Event. Nothing in this Section affects any statutory rights that the User may have as a consumer.
14. Limitation of liability
Nothing in these Terms shall limit or exclude Cocodum's liability for: death or personal injury caused by its negligence; fraud or fraudulent misrepresentation; or any other liability which may not be excluded or limited under the law of England and Wales.
Subject to the foregoing:
- Cocodum shall not be liable for any loss or damage arising out of any dealing, transaction, dispute, communication, item, service or Event between the User and any other User or third party.
- Cocodum shall not be liable for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill, opportunity or data.
Where the User is a consumer, it has legal rights which are not affected by these Terms.
15. Prohibited items and content
The User shall not post, offer, sell, advertise or promote any item, service or Content that is unlawful or otherwise prohibited by Cocodum, including:
- weapons, firearms, ammunition, explosives and offensive weapons, and their parts;
- illegal drugs, controlled substances, psychoactive substances and related paraphernalia; tobacco, nicotine and vaping products where prohibited or age-restricted;
- counterfeit, fake or replica goods, and items that infringe intellectual property rights;
- stolen goods, or goods which the User has no right to sell;
- adult or pornographic material, sexual services, and escort or similar services;
- content that sexually exploits or endangers children, terrorist content, or content that incites violence, hatred or discrimination;
- live animals and protected species or their parts, where their sale is restricted or prohibited;
- human body parts, bodily fluids, organs, and medicines or prescription-only products;
- government documents, identity documents, and the personal data of third parties;
- hazardous or recalled products;
- financial products, currency, cryptoassets and gambling services offered unlawfully or without the requisite authorisation;
- any other item, service or content that is illegal, dangerous, deceptive or contrary to these Terms or to Cocodum's posting rules.
Certain categories are additionally subject to legal restrictions (for example, as to age, licensing or labelling requirements), with which it is the User's responsibility to comply. Cocodum may update this list at any time.
16. Additional provisions applicable to Traders
This Section applies in addition to the remainder of these Terms where the User uses the Website as a Trader.
Distinction between Trader and Private. A Trader acts for purposes relating to a trade, business, craft or profession (including, for example, resellers, shops, dealers, professionals and any person selling or advertising in the course of a business). A Private acts as a consumer, for purposes wholly or mainly outside any business. Any User which is a company, or which represents a company, and which uses the Website for business or trade purposes, must use a Trader account.
Misuse of a Private account. The use of a Private account to carry on any business or trade activity constitutes a serious breach of these Terms and may result in the immediate suspension or permanent ban of the account and the removal of the User's listings.
Trader obligations. Each Trader shall, in particular:
- clearly identify itself as a business and provide accurate business particulars;
- comply with all laws applicable to its activity, including consumer protection law (such as consumers' rights to information and, where applicable, to cancel), pricing and labelling requirements, and its tax obligations;
- ensure that its Ads, Events and any advertising are lawful, honest, decent and truthful, and are neither misleading nor aggressive;
- discharge its obligations to buyers and other Users directly, Cocodum not being involved in its dealings.
17. Complaints
Any User wishing to make a complaint regarding the Website, a listing or Content should contact Cocodum at contact@cocodum.com or through our Contact page, providing sufficient particulars to enable Cocodum to investigate the matter. Cocodum shall consider the complaint and respond within the period required by law where a time limit applies. Disputes between Users should, in the first instance, be resolved directly between the Users concerned; Cocodum is under no obligation to act as mediator.
18. Data protection
Cocodum processes personal data as set out in our Privacy Policy, which describes the personal data collected, the manner of its use, and the User's rights. By using the Website, the User acknowledges that Policy.
Where a User obtains the personal data of another User through the Website (for example, a telephone number or address in order to arrange a transaction), it alone is responsible for the use it makes of that data. The User must use such data solely for the purpose of dealing with that other User in connection with the relevant Ad or Event, must comply with data protection law, and must not use such data for marketing or any other purpose in the absence of a lawful basis and consent.
19. General provisions
- Severability. If any provision is held to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
- No waiver. Any failure by Cocodum to enforce a right shall not constitute a waiver of that right.
- Notices. Cocodum may give notice to the User through the Website or by email. The User may contact Cocodum at contact@cocodum.com.
- Force majeure. Cocodum shall not be liable for any failure or delay caused by events beyond its reasonable control.
20. Governing law and jurisdiction
These Terms and the use of the Website are governed by the law of England and Wales, and the courts of England and Wales shall have jurisdiction to determine any dispute arising out of or in connection with them. Where the User is a consumer resident in another jurisdiction, it may additionally benefit from any mandatory protections afforded by the law of its country of residence, of which this Section does not deprive it.
As stated in Section 1, these Terms are furnished in English and in French, and the English version shall prevail in the event of any discrepancy.
